This study aims to analyze the occurrence of parental alienation as a violator of the right to the healthy family living and the feasibility of reducing cases of Parental Alienation with the application of shared custody. Alienatory acts, because they are considered abusive against the rights of the child and the adolescent, and always observing the best interest of these beings as people in development, such practice requires measures that aim to guarantee the exercise of that right. The study is structured in such a way as to draw attention to the psychological consequences that affect the minor children, victim of alienation. Initially conceptualized the family and later was made a historic evolution your. It was noticed that the institute goes far beyond a restricted concept which had to the groups formed by marriage, prioritizing the affection as an essential element to there cognition of any relationships that may form. The main point of this study is the discussion about parental alienation, which bills itself as a cruel mechanism, generally used by parents who do not have overcome the end of the validity of marriages, by using the child as an element of revenge to achieve the other spouse, hurting both the right of personality of children and adolescents, as the right to healthy family living, this is fundamental to the development of the personality of the child or adolescent. Since the parental alienation a hindrance to the exercise of this right, in joint custody, living with both parents, a means of reducing the practice so abusive against minors.
