Resumo:
This paper aims to function as a guide of the DPVAT insurance - Mandatory
insurance for Personal Damage Caused by Terrestrial Automotive Vehicles, as way to
make this insurance known, unknown by many, explaining the entities, performance
regarding is functioning, historical development, the legislation it is pertinent to, the
analysis of controverted points and different knowledge about the issue and, in special,
show its practical form, with theoretical and jurisprudential approach, the best way to
receive payment of the prize of the whole insurance. In its elaboration, they tried to
create a new source of research, since there are few didactic sources about the issue,
basing, fundamentally, on the interpretation of the laws, resolutions and the judged ones,
thus, they conclude that the main reason for the choice of the theme was to observe the
doctrinarian an jurisprudential knowledge aiming to clarify the divergences found in our
right, when it comes to Mandatory Insurance DPVAT issue, approaching as the key
word the compensated values in case of traffic accident, once it is of great importance
for the society to recognize their rights.
