Resumen:
in times of prisons and jails crowded public and recurrence in cases of inmates who
served a sentence of imprisonment superiror index to seventy percent, alternative
sanctions emerge as an efficient way to recover an individual, replacing the ills of
themselves prison for a new form of imprisonment, which more than punishment, is
an opportunity to educate the offender that crime does not pay. It is known that the
inmates that meet this kind of reprimand, as a rule, are those who commit crimes of
small and medium-Linux potential offensive, whose behavior and personality do pose
real risks to society, and did not, therefore, that the Brazilian State to offer them the
same answer reserved for criminal convicts highly dangerous, justifying therefore
different treatments. The objective of this research is to indicate the alternative
punishments to be an effective reintegration of inmates into society, provided there is
adequate monitoring the implementation and enforcement of these penalties. In
developing this work is intended to present a history of penalties alernativas and its
peculiarities. Then, the purpose is to make a digression on the criminal justice
system, noting the advantages and disadvantages which alter the penalties. Finally,
we analyze the implementation of criminal law in light of studies undertaken on the
management of people, especially, there are devices and related legal principles, this
law was to identify the form of management adopted regarding the execution of
alternative sanctions. To this end, we resort to the technique of literature, employing
the inductive method to the investigation, and legal exegesis and, aided by historic
and methods of procedure. As a result of this paper notes the difficulties encountered
in implementing an appropriate system of management to exert control and oversight
in the implementation of alternative sentencing in the criminal justice system, able to
contribute significantly to social reintegration of the offender.
