Resumen:
Inclusive Education is undoubtedly a major challenge for society. Although the
fundamental rights of the Federal Constitution, especially education, are
guaranteed, there is a great deal to be done in order for these rights to take
effect, which involves much more than the disabled person, also involves the
family, school, society, the State. Therefore, the present study seeks to: analyze
education as a fundamental right, in light of the law 13,146 / 2015, called the
Statute of the Person with Disabilities, which advocates the guarantee of
benefits and measures for greater equality of inclusion of persons with
disabilities in society, reflecting on the importance of inclusion of students with
disabilities in the regular class. The present research was developed through a
bibliographical review, and as method of approach was used the deductive
method, based on legislation and authors who discuss the subject. From a
reflection on the theme, it is understood the importance of a fair education and
for all without any type of segregation, promoting the insertion of people with
disabilities into community life as citizens.
