Résumé:
This work seeks to show society, the importance of the Jury, its history during all the
Brazilian Constitutions, it also makes a comparative table of the Brazilian Popular
Court with other countries, traversing and demonstrating the great importance of the
Jury's principles, as well as the vital need for the fundamental rights of the accused to
be respected, not only for the defendant himself, but also for the population in
general, after all, the people's court has the effective action of the people through the
composition of the judges by impartial people in society, thus, this media interference
has caused the result of the courts to conform to the media judgment, known as a
trial by media, that is, a judgment made by the media, thus ceasing to be an impartial
court, to be partial to according to the vision of the communication channels. Through
a bibliographical research and using the method of inductive approach, we arrive at
this negative conclusion of the total or partial rupture of the rights of the accused
within the trial of the jury.
