Resumen:
The legalization of cannabis sativa has gained momentum in debates about its medicinal use, allowing more space for the benefits of the plant to be studied and discussed with the right seriousness and importance. The research has intention to carry out a critical analysis about the drug issue in Brazil, navigating through the pillars of justice, integrity and the right to health. In relation to the scientific process, the method used was the historical-evolutionary method. Therefore, this work has the goal of addressing the history of cannabis sativa in Brazil, through the discussion about the Drug Law (Law 11.343/06), covering how the regulation’s current (in)effectiveness in the country is occurring, since the law demonstrates difficulties in establishing the difference between drug dealer and user. The study also points to the Brazilian prison problem of overcrowding, considering that today, one in three prisoners responds to drug trafficking, according to a survey carried out by state governments and courts of justice and seeing that a clarification is necessary and urgent to differentiate the user from the trafficker. It also addresses the genocide of the black population, which are the first individuals to suffer from the repression of the current drug war, since the profile of the drug dealer in Brazil is young, black and poor. We talk about the importance of the intersectionality of public policies, considering the perspective of knowledge sharing. There is also a serious reflection about the current forms of clinic treatment with marijuana and some of its derivatives, such as cannabidiol (CBD) and tetrahydrocannabidiol (THC). In the end, there is a dialogue about the authorization that the Brazilian Association of Support Cannabis Esperanza - ABRACE, from João Pessoa - PB, received from the Federal Court of Paraíba, to maintain the cultivation and manipulation of cannabis sativa for therapeutic purposes of the 151 associates or dependent patients associated with the process.
