Resumo:
Late adoption is conceptualized as the adoption of children over two years of age,
since they do not fit the preference of most adopters, who would be of newborn
children. Thus, the problem of the present study was to understand how the
bureaucracy influence the late adoption and which situations contribute to the
permanence of children and adolescents in institutional reception centers. This
monograph had as general objective to analyze the bureaucratization of the Brazilian
laws that deal with the adoption and situations that influence the permanence of
children and adolescents in institutional centers for years, allowing them to age, in
order to reduce the chances of insertion into the family substitute. In addition, the
objective of the research was to conceptualize the adoption in Brazil, analyzing the
history of the adoption institute; tracing the historical-legislative evolution of the
institute of adoption in Brazil; and, providing statistical data regarding the adoption of
children and adolescents in Brazil. The methodology used was the deductive,
through a descriptive, qualitative and documentary research, through websites,
doctrines, scientific articles and Brazilian legal legislation. After the research, it was
realized that a multidisciplinary union was necessary, including the legal,
psychological, social and other areas that can cooperate, leaving the legal system
more agile, as well as expanding the support system for these children and
adolescentes, in order to demystify the process of adopting older children, to
increase adoption rates. It also became possible through the research to confirm
some hypotheses that contribute to the permanence of the children and adolescents
in the centers of reception and in the national register of adoption.
