Resumo:
The present study has as general objective to analyze the obstetric violence in Brazil and in
some South American’s countries where it is typified, through a comparative of his
legislations. At the outset, it provides an overview of the documents considered to be key to
the development of fundamental rights and, consequently, their inclusion in the 1988
constitutional text, especially with regard to women's rights. It also addresses the issue of
violence against women, especially obstetric violence. In this line, this kind of violence is
analyzed, from its origin to its repercussion in the present day, listing its main characterizing
forms. In addition, a legal approach to this violence is made, through the analysis of foreign
laws regarding obstetric violence and the draft laws in process in Brazil, and, in the end, a
comparison is made between these laws. For that, a qualitative research methodology is used
as a methodology, through a bibliographic study, analysis of relevant legislation, institutional
research and scientific articles.
