Abstract

It is known that since birth, the family is the main nucleus of socialization and formation of the child's character. Given their situation of vulnerability and immaturity, their first years of life are marked by dependence on the environment and those who care for it. The affective relationship with your parents, or substitutes, is fundamental for your constitution as a subject, affective development and acquisitions of the age group itself. The Brazilian legislator did not neglect this aspect, so much so that in Article 227 of the Federal Constitution of 1988, it enshrines the right to family life, as well as the Statute of Children and Adolescents, followed in the same path, as quite advanced legislation, reinforcing this understanding. However, it is not always possible for the child and adolescent to remain with their biological parents, and sometimes their inclusion in a substitute family is even more appropriate through adoption, a very old institute, which in the current outlines has the primary function of ensuring a family for both adopting and adopting. And in the context of this problem surrounding the adoption process in Brazil, the legislation in this regard and, above all, the role of the social worker in the insertion procedures of the child and adolescent in a substitute family, notably through adoption, which develops the present work. It seeks to make explicit the pertinent legislation to children and adolescents in Brazil, in addition to the analysis of the Social Service of the development of this profession, nowadays, with such a strong performance in the Courts of Childhood and Youth as members of the Inter professional Team provided for in the ECA itself. Thus, it is intended, as a general objective of this work, to expose, repeat, the role of the social worker in the sphere of the judiciary, notably in the processes of insertion of the child and adolescent in a substitute family through adoption. Furthermore, the specific objectives are to investigate legislation that deals with the rights of children and adolescents in Brazil and its evolutionary process; emphasize Social Work, its creation and the entire evolutionary process of the social worker profession; demonstrate how the social worker works in the process in practical terms, pointing out the contribution of this professional's performance to achieve the ECA's major objective, the search for the well-being of children and adolescents. To this end, it will be used as a hypothetical-deductive method, as a method of approach, since starting from general information contained in the legislation and doctrine consulted for particular statement, as methods of procedure the hypothetical-deductive method will be adopted, aided by the historical- evolutionary, in order to carry out bibliographic research. The conclusion pointed out by the research moves towards demonstrating the important mission of the Social Service professional in affirming the rights of children and adolescents, especially the right to family life.
