Resumo:
In the context of redemocratization with the Federal Constitution of 1988 and the increase in crime, expertise becomes relevant as a segment responsible for producing material evidence, as well as promoting justice. The investigation became more prominent in the investigative scope with the creation of the Code of Criminal Procedure, replacing the former Code of Criminal Procedure. The code itself provides expert evidence, in the form of examination of a body of crime, as indispensable to the legality of the process, which may also include procedural nullity. Therefore, criminal expertise is an auxiliary body of justice responsible for the collection, investigation and production of evidence in crimes that leaves traces. Criminal expert is the professional responsible for performing the criminal expertise, must possess vast experience and specific knowledge in certain areas. A bibliographic methodological research was carried out, based on literatures referring to expert evidence, where concepts, institutes and principles of recent doctrine were defined, as well as semi - structured interviews as a means of data collection. The objective of this research is to develop a study on criminal expertise, specifically about its performance in the State of Paraíba. Is the criminal investigation exercise in the state of Paraíba effective for demonstrating the real truth in criminal cases? The research is divided into four chapters where: the first comprises an in-depth teaching on criminal expertise; the second deals with criminal expertise in the face of criminal proceedings; the third proposes to discuss the performance of the expertise in the State of Paraíba; Finally, the fourth, and last chapter, presents interviews with professionals who deal daily with the criminal expertise in Paraíba. The paper proposes to analyze the concept of the expert evidence and its guiding principles, the practical difficulties faced by the experts from Paraíba and to identify ways of improving this forensic science.
