Resumo:
This research has as study object the analysis of the contradiction that is currently in
the legal system as the recognition of the right to transsexuality. The methodology
used in the study was performed using the deductive method of approach, the
exegetical procedure - legal and the technical literature. The study is developed
initially through a clarification on the characteristics of their own transsexuality, how is
manifested in the individual as well as their diagnosis, its scientific definition and
differentiation of other sexual orientations. In a second phase, further focus on
transsexuality and being. The surgical process of sexual readaptation, the steps that
need to be addressed before this procedure and how society receives the new status
of these subjects. Finally, we analyze the legal system and the transsexual before
and after treatment of sexual readaptation, realizing and punctuating the gaps and
omissions and contradictions present in partial recognition of some rights that turn
out not allow this individual to enjoy full form of citizenship. Finally, to complete the
survey, we observed that the results were based on the existence of, because there
are still many doctrinal controversies on the theme, a discretion field is created given
