Resumen:
The security measures are the way to punish attributable to demonstrate risk. They
are essential for the progress of society whereas in Brazil, there are countless people
who need some psychiatric care thus, this monograph has a main objective to
analyze the needs of installation Custody Hospital and Psychiatric Treatment in the
outback of Paraíba. This is a qualitative research, carried out by the deductive
method with bibliographical and jurisprudential research. Thus, the reflections begin
by deepening the Principle of Human Dignity, reaching its various concepts and how
it has been incorporated into numerous treaties around the world, and its
incorporation in the Federal Constitution of Brazil 1988. Then follows an analysis of
the security measure addressing who may be subjected to such a measure, about
how this works as criminal responsibility who is carrying mental disorders, in
additional to demonstrating the development of the measure in the course of time,
the need for examination Mental health and the cessation of the risk of the inpatient.
Finally, it analyzes the real need of Custody Hospital facility and Psychiatric
Treatment in Paraíba outback, legal and jurisprudential aspects that cover up this
need, and it brings an overview of the reality of the Brazilian prison system and the
recognition of the punished carrier of mental disorders.
