Abstract:
The present study proposes to analyze the freedom of expression under its historical
and social aspect in order to understand to what level international and national
protection has risen. Thus, under an analysis that confronts it with other positive
human rights as image rights and honor rights that are commonly confronted with the
freedom discussed in the context of humorous discourse. Therefore, it brings up an
appreciation of the State's juridical approach in defense of the rights of personality
against the censorship of humor and the right to satire. Finally, with the purpose of
pointing out that censorship will come through the means that society has - as the
internet - placing it as active beings in a network of opinions, it was searched through
a methodology focused on the deductive method and historical method confront how
social censorship should compose the active space that human beings would have in
defense of its ideals and consequent rights, thereby making an alternative to the
institutionalized criticism that was so rejected at the time of the Military Dictatorship.
