Abstract:
The present work has as objective to analyze the effective violation of administrative probity and the constitutional principles of legality, impersonality, morality and efficiency as a result of political indications from nepotism. The history of corruption in Brazil began with the arrival of the Portuguese crown and its colonizing process and extends to the present day in which the influence traffic is allocated in the possibility of appointments to positions of free appointment and exoneration. Given the historical social evolution of the country, the transformation of the legal system that created mechanisms of protection of the values inherent to the adequate administration as a benchmark of the public interests is verified, being demonstrated in the research the process that led to the configuration of the current normative system. In view of this fact, it is sought the interpretation of the courts' understanding regarding the application of Súmula Vinculante nº 13 as well as the law nº 8429/92 in cases of nepotism and improbity. For the realization of the project were used the methods deductive, systematic and historical, being carried out through bibliographical, doctrinal and jurisprudential research to prove the alleged facts.
