Resumen:
The present research deals with the abuse of power in the Brazilian Public Administration,
studying its emergence, structural formation, the powers and purposes that it possesses,
aiming at investigating abusive practices in the exercise of the powers conferred on public
agents and the duties that The administrator must have in order not to focus on such practices.
In this way, an analysis was made to understand how is the institute of the abuse of power, as
well as the means to curb such conducts, and the behavior of the managing agents. The study
praises respect for remedies and constitutional procedural mechanisms in the fight against bad
administration. Using works of administrative law, articles, magazines on the internet and
jurisprudence on the subject discussed. Demonstrating the importance of using the powers
conferred on the agents, always emphasizing the duty of not using them diverted from the
proper end. The deductive method of approach was chosen to better achieve the proposed
goal.
