Resumo:
This monographic study studies the crimes that devastate social security in Brazil,
through the use of illegal evidence, in an attempt to circumvent the administrative
and/or judicial process for granting rural benefits. This issue was chosen in view of
the large proportion that social security crimes have reached in recent times, given
that this harm affects a great part of Brazilian citizens, especially the rural class,
which is one of the largest classes of insured in the country, if not the largest and
easiest to be deceived. This research was elaborated through bibliographical
references, in books, codes, jurisprudences and sparse laws, selected to check the
theoretical basis of any monographic text, it was also used the access to websites for
the search of scientific articles that had relation with the subject in comment. Finally,
one can conclude the changes that occurred during the entire historical and
legislative evolution of social security, why the special insureds are the most
prominent target of criminals, the study of each crime in particular and its
consequences in the face of doctrine and jurisprudence.
