Resumo:
The present work had the wand to analyze service contracts for outsourced company
and the responsibility of the State as such contracts. Initially it was analyzed the
origin of the outsourcing Institute in the world to then glimpse the origin in Brazil,
listing and concepts rise of this Institute. In the initial chapter that dealt with the
historical evolution, the analysis of the subject under discussion, took into account
the production modes and the development of society and economy, showing how
capitalism developed, and outsourcing. With outsourcing in enough use in Brazil the
legislature and the judiciary had to regulate his institute, obligations, duties and rules
of how to proceed. Later the Public Administration came to use this institute to meet
the demand of society, delivering activities that were not unique to the public
administration for sub-contractors, coming so the regulations arises about the topic
and the possible responsibility of public administration by the acts carried out by subcontractors. The focus of this work is based mainly on this aspect, in which there is
some disagreement on the subject, in order to clarify other points and really know
what portion of the fault of State activities made by outsourced
