Resumo:
This study aims to determine the general aspects of legislative power at the
municipal level the light of the constitution 1988 , highlighting the powers conferred
by the constituent. The method adopted is exploratory and is guided in the literature
review. Contextualizes the Legislature from the analysis of the legislative process
and legal fees. Scrutinizes the role of the municipality in the Brazilian state. It
highlights the separation of powers governing the autonomy and independence of the
executive, legislative and judiciary. Emphasizes the autonomy of the Municipality
enshrined in the Constitution of 1988. Republic Discusses Power City Council, its
attributes and autonomy. It presents the division of powers and the role of regulation
at the municipal. We conclude that the Constitution of 1988 greatly honored the city,
recognizing their autonomy to devote exclusive and concurrent powers, enabling self-organizing capacity, which calls for legislative activity to materialize, given the local
interest.
