Abstract:
The present work deals with the topic of breastfeeding in the context of the
accomplishment of imprisonment. The analysis is guided in the study of scientific
findings about the benefits of breastfeeding, nutrition, immune and its affective. As
well as the national legislation regarding breastfeeding, especially regarding the
constitutional right to health, to food, to family living and human dignity. Finally, we
sought to understand the effectiveness of normative constitutional device that
ensures the breastfeeding in jail, with the aim of investigating the constitutionality of
that discipline the infra-device theme. To this end, the study will establish qualitative
analysis of related legislation in the field of lactation in jail, confronted with the
constitutional principles and guarantees, in addition to the theoretical study of the
effectiveness of normative constitutional requirements, through bibliographical
