Menor em conflito com a lei: um análise sócio-jurídica à partir do estatuto da criança e do adolescente.

Abstract

In the present day, what is observed is the increase of crime, especially the increase of number of youth people committing such crimes, highlighting one of the biggest problems that our society faces. Many people turn their eyes in a punitive sense of the thing and end up forgetting the most diverse factors that end up the younger that practice these infractions, it is in the second point to understand what to those younger to carry out these infractions. Among these factors, the institute of family, which is take as the base for our whole formation as a sociable being, such an institute influence on the psychosocial construction of these minors and subsequently on their relationship with violence. The respective theme also exposes the lack of politic on the organizations responsible of trying to resocialization of the minor offender and for the prevention of this when faced with the seduction of the world of crime. To achieve this objective, the present study uses the hypothetical-deductive, as well the method of historical-evolutionary procedure, and the research documentary. The adopted research technique consists of indirect documentation, through of bibliographic research, when analyzing legal devices, specialized doctrines, as well as articles and monographs on the subject. It is considered relevant importance of their work, give that much is talked about the punishment of the minor in conflict with the law and is discussed about the factors that end leading to the commission of these infractions, which are the heart of the whole problem.
