Abstract:
The present study intends to analyze the applicability and effectiveness of the "Listen
to hear you" Project, before the cases brought before the Court of Justice of the State
of Paraíba. The problem of sexual abuse has been present since antiquity, and the
approach on the subject is relevant because of the incidence of cases of violation of
the rights of minors in the national scenario, in which it is necessary to create a device
Legal that disciplines the Institute of the Testimony without harm, as a way to
guarantee access to justice and to avoid the revictimization of child and adolescent in
situation of sexual violence. In order to do so, it uses the dialectical method as a
method of approach, evolutionary history as a procedure method, as well as
bibliographical and documentary research as research techniques, as well as
unstructured interview with Project Manager at the Paraíba Court of Justice. Thus, it is
questioned: Is there applicability and effectiveness of the "Listen to hear you" Project
in the Counties of the State of Paraíba? Thus, this study evidences the existence of
legislative gaps as to its effectiveness, since such an institute is a mere
recommendation of the National Council of Justice, being optional the application by
the Courts.
