O presente trabalho tem como tema pesquisa jurídico-social sobre os haters e os crimes cometidos no Brasil. Nesse contexto, como há conflitos entre homens, verifica-se necessário um estudo basilar histórico da convivência em sociedade, para, por conseguinte, realizar uma análise doutrinaria do conceito de crime, definindo como sendo toda ação ou omissão, típica, antijurídica e culpável. A historicidade da internet é de suma importância para entender o tema em questão, pois os haters, que são os atores que postam mensagens de ódio, atuam em ambientes virtuais. Cometem, assim, crimes virtuais, que podem ser próprios ou impróprios, sendo, respectivamente, aqueles que só podem ser cometido no mundo tecnológico, e aqueles em a tecnologia é uma mera ferramenta para a execução da conduta. Analisa-se assim quais são os crimes mais comumente cometidos na rede, além da legislação pertinente e seus limites de aplicabilidade, onde, em se falando de tais crimes, verifica-se a existência de lacunas na lei, no que diz respeito aos cibercrimes próprios. Registra-se ainda que se faz necessário antecipadamente um estudo sobre as comunidades virtuais e as redes sociais, onde o usuário é capaz de criar uma imagem digital que reflete seu eu real, atualmente muito presentes no dia- a-dia da sociedade. Através de pesquisa quantitativa percebe-se a preocupação da população brasileira com a segurança virtual. Diante dos haters que atuam nas redes sociais, fica demonstrado com clareza o modo de atuação, e quais são os principais crimes cometidos pelos mesmos. Quanto às vítimas, evidencia quais são
as principais, como também a importância do apoio psicológico para evitar conseqüências mais graves. Além disso, constata-se que há pessoas que investigam esses crimes, pelo menos quando há a denuncia por parte da vítima. O presente trabalho aponta algumas soluções jurídicas, tais como o preenchimento das lacunas da legislação, no tocante aos cibercrimes próprios, não necessitando assim de um novo Código Penal, ou outra nova lei. Ainda como solução, se faz necessário que sejam criadas ferramentas que fiscalizem as redes sociais e automaticamente investiguem autores de crimes odiosos no caso de ação publica incondicionada. Ante o exposto, como há um vasto conteúdo para entender os haters, apura-se imprescindível um estudo minucioso de cada tema exposto, para
que enfim poder abranger os objetivos desejados. |

This work has the theme legal and social research on the haters and the crimes
committed in Brazil. In this context, as there are conflicts between men, there is
required a historical basic study of living together in society, therefore, conduct a
doctrinal analysis of the concept of crime, defining as any action or omission, typical,
wrongful and culpable. The historicity of the internet is very important to understand
the issue at hand, because the haters who are the actors who post hate messages,
work in virtual environments. Commit, so cybercrimes, which may be suitable or
unsuitable, and, respectively, those that can only be committed in the technological
world, and those in the technology is merely a tool for the implementation of conduct.
Analyzes so what are the crimes most commonly committed in the network, and the
relevant legislation and its applicability limits, where, when talking about such crimes,
there is the existence of loopholes in the law, with regard to own cybercrimes . It is
recorded even though it is necessary to advance a study of virtual communities and
social networks where the user is able to create a digital image that reflects your real
self, now very present in the day-to-day society. Through quantitative research we
see the concern of the Brazilian population with cybersecurity. Before the haters who
work in social networks, it is clearly demonstrated the mode of action, and what are
the main crimes committed by them. As for the victims, shows what are the main, but
also the importance of psychological support to prevent more serious consequences.
Moreover, it appears that there are people who investigate these crimes, at least
when there is a complaint by the victim. This paper points out some legal solutions,
such as filling the gaps of legislation, with regard to own cybercrimes, not thus
requiring a new Penal Code, or another new law. Even as a solution, it is necessary
that tools are created to oversee social networks and automatically investigate
perpetrators of heinous crimes in the case of unconditioned public action. Based on
the foregoing, as there is a vast content to understand the haters, clears up essential
a detailed study of each subject exposed to that power ultimately cover the desired
goals. |
