Resumen:
When commit a crime, the subject brings about to the State to obliged/ empowered to
punish, should be applied a penalty if imputable or a safety measure, if unimputable
or semi-imputable. This study addresses the criminal law as Legal Science, the main
personality disorders and the application of the appropriate criminal penalty for
crimes committed by individuals with psychopathic personality. Thus, it will have as
general objectives, the criminological profile approach of the agent with psychopathic
personality, as well as the appropriate criminal penalty to those individuals who
commit crimes, demonstrating the need for an expertise specific to obtain an
accurate diagnosis, conducted by specialized professionals, making a brief historical
survey, conceptualizing and addressing the levels of dangerousness of the offender
agent. The subject will be exposed three chapters and an annex where the first sets
out the legal science, which is the criminal law, its evolution, concept, features,
principles and sources; the second is an approach to personality disorders, with an
emphasis on antisocial disorder and draws a criminological profile of the agent; the
third joins the first two chapters and addresses penalty notions of security measures
and what the criminal penalty is suitable for application to the individual with
antisocial personality disorder, if it may commit crimes; Finally, the study brings
brings an attachment with analysis of three specific cases and penalties applied to
these. It is used as methods of procedures historical-evolutionary and exploratory, as
the object, use the qualitative method, and as a research technique, bibliography.
