Resumo:
In the Brazilian legal system, in which deals with animal protection, is and has always
been very lacking, because the Civil Code considers them as objects which can be
owned for law effect, property that of humans, where they can use, enjoy and dispose
these sentient beings, and donate them, sell them and abandon them in violation of
the Magna Carta and the basic rights guaranteed by it to all animals. This study aims
to propose solutions about the neglect that occurs when it comes to animals, with a
study of what exists in our law on this subject, in order to examine and propose
measures that help to ill-treatment. In this work will be used as a method of approach
deductive, with a view, which studied how is the protection of animal rights, the current
effectiveness of legislation in combating abuse and the filing methods that alleviate this
problem. It concludes that people can ensure a harmonious coexistence to non-human
animals with their rights, considering the effect of environmental protection, enabling a
sustainable coexistence between humans and animals, consequences of the legal
effects of diffuse rights.
