Resumen:
This work monographic is to scope the study of social and educational measures, in
order to verify if your application reaches effectively the objective of social reintegration
of the young, in order to avoid the situations that led him to commit the offense be
repeated, since most of the time, after its application, juvenile delinquency recurs. Thus
we come to analyze the aspects that revolve around the constitutional amendment
project 171/1993 that proposes to reduce the legal age in Brazil, which is now treated
by some as the solution to youth crime in the country, however, there many scholars
and lawyers who say they are opposed to reduction based on several arguments,
which will be discussed throughout this academic work. This research is of paramount
importance, given the fact the Federal Constitution establish in its art. 227, the full
protection of children and adolescents, making it clear that it is the joint responsibility
of the state, the society and the family to ensure the rights of those. In addition there
is the discussion about a new way of solving the legal and educational problems facing
adolescents, seeking accountability of the offender through dialogue between the
parties, seeking to solve the conflict and repairing the damage, is called Restorative
Juvenile Justice .
