Abstract:
This study, using the deductive method and bibliographic technique seeks to analyze
the use of the judicial equivalent mediation as an efficient means to resolve
environmental conflicts, in order to search the effectiveness of both the constitutional
guarantee of having a healthy environment, as the give a better adjudication against
assurance of the fundamental right of reasonable duration of the process, but without
giving up the environmental well. During the work analyzed at first the mediation
institute and subsequently the environmental good, and end the use of mediation in
conflicts whose interest to act in protection and / or recovery of environmental good.
Finally, he met both legal foundation, as judged and examples in the Brazilian legal
system, which proves to be possible to use mediation as possible to resolve
environmental conflicts, however, without this giving up the environmental well.
