Resumen:
The following scientific work seeks to examine a possibility or not of unmotivated dismissal of public employees who work in public companies and mixed-economy societies that exercise the economic activity. Subject that involves several legal controversies and must be deeply studied because of its great social relevance for the fact that there are thousands of people who are under these circumstances. Above all, due to the need that the public employees do have to go through a public tender, hard work that requires dedication, and that aiming at a more stable financial life they can live with insecurity, for possible immotivated dismissal of their public positions. This way, this monographic research will address the explicit and implicit principles surrounding the performance of the Public Administration, besides its organization, analyzing the role that each administrative entity plays within society. It will also be studied in a specific way how it does the entry of public employees in the case of State-owned explorers of economic activity, since they are the central objective of our study. In addition, it will be object of analysis the doctrinal and case laws positions that revolve around the subject, being examined also the instrument of the Plan of Voluntary Resignation that is quite usual in state explorers of economic activity. And finally, concluding on how the reality will be if the understanding is consolidated due to the lack of motivation in the dismissal of these employees. In this research, the deductive approach was used as method, arguing that one must pick up general premises for individual conclusions, besides the method of bibliographic procedure.
