Resumo:
This monograph consists of the study of consequences of Puerperal Condition in Illicit
Infanticide Crime as manslaughter, typified in article 123 of Brazilian Penal Code described
as the act of killing her own child during childbirth or soon after. Talks yet about the
characteristics and peculiarities of Puerperal Condition, describing the types of psychiatric
disorders, among them, the puerperal psychosis, that arises abruptly in the first weeks
postpartum. In Puerperal Condition the mother does not control his actions, under the control
of delusions and hallucinations, unable to distinguish the real from the imaginary, can
eliminate your child's life without the bad conscience that is making , finding themselves
unable on grounds of insanity. This being the crime committed since ancient times and its
sanction imposed more banal to the most extravagant. The theme is the subject of numerous
discussions for professionals in the health as of right, where it is examined the puerperal
condition on the crime of infanticide as a possible cause of exclusionary of guilt in view of the
unaccountability of the mother caused by mental illness and not having the understanding to
separate legal from illegal , getting released from mother's penalty.
