Resumo:
The objective of this work is to show that the prison sentence needs to be reformulated and
used minimally possible, creating alternatives to substitute in many cases the prison, because
it has not been able to execute its objectives of providing the resocialization of the person who
is imprisoned and the prevention of crime. The mass imprisonment has caused many
problems in the prison system in many countries of the world and especially in Brazil. The
degrading situation experienced by those serving sentence in Brazil, where they are violated
human rights by the absence of minimum conditions which guarantee the dignity in serving
the sentence has been a major obstacle to the recuperation of the person who is imprisoned. It
makes the society seeks to build alternatives to minimize the effects of the chaos experienced
by the national prison system. Faced with so many challenges, the society needs to know and
get involved in the debate on the prison system. The electronic monitoring has been
mentioned as one of the main alternative measures to minimize the overcrowding of the
prison system and help to maximize the possibilities of social reintegration of the convict,
since the chances of recuperation are much greater when the individual can execute his
sentence keeping bonds of social life
