Résumé:
The research aims to reflect the problem of the freedom of the press, which has
become a powerful tool of the dissemination of information in the present time, thus
becoming an extreme necessity for the social environment, providing in a way noninvasive
information in the intimacy of each individual. The present work focuses on
the need for the diffusion of thought / news without the violation of the privacy rights
of others, stating that privacy is the right of every citizen, besides defending the
impartiality of the media to prevent social manipulation. The problem addressed in
this research is related to the non-influence of the media in society, and may not
influence, but inform each citizen of what is being exposed in the world. Exposure of
private data and images in the media, press interference in processes that occur in
justice secrecy and the legal consequences of such violations are of legal
responsibility, privacy as well as the possibility of redress of these with moral
damages. As for the methodology, it was opted for the historical-deductive approach,
through studies of laws, doctrinal and jurisprudential research, as well as
bibliographical and documentary sources. The main contributions are the importance
of this research in the brazilian scenario and, above all, the addition of interesting
points as knowledge for other investigations that aim to deepen studies on media
freedom, its historical evolution, principles and the right to privacy.
