Résumé:
The American Convention on Human Rights brings in it the right to social integrity,
respected in three aspects: physical, mental and moral. Given its wide importance,
the Republican Charter 88 to introduced as a fundamental precept of the brazilian
legal system, called it like a principle of human dignity. This is the basis for the "rehab
of the condemned" because he is below a state custody and, once bearing his
obligations, he is entitled to return to socity. However, it is known that the
discrepancy between the legal text and the prison reality is alarming, given that the
rule is overcrowding, violence and others.The state, in an attempt to reverse this
situation, created a Differentiated Disciplinary Regime-RDD; it's the total isolation of
the offender. This creation is questionable for the doctrine, because seen it like a
violating the principle quoted above and without any practical effect, in a country
penitentiary system.
