Resumen:
This currently work makes an explanation about harassment in the
individual working relationships focusing the ethical dimension at the company and
the importance in fighting against this abuse searching to protect the psychic and
physical health of the worker. The theme's importance is justified by the necessity to
question the relevance of ethical policy implementation inside the company which
protects the relationships among employers and employees in order to avoid
psychological abuse, especially the harassment. Methodology will be used in this
academicals work is characterized by developing a research of qualitative nature,
using as procedure method, the hypothetical-inductive that through doctrinal analysis
and several situations related to the theme, it tries to provide solutions to the
question, with this approach mostly focused on the worker welfare. The theoretical
basis was searched in sources like books and interactive sites, using the indirect
documentation research. It was realized from the abstract features of harassment
analysis, it come to conclusion in this case if there was the harassment practice or
not, considering rather important that the victim keep all evidence that proves the
harassment occurrence in order to plead an indemnity by the harm suffered. It was
evident that the ethical conduct inside a company brings not only internal benefits, as
also external when benefits the whole community. Furthermore, it was found in the
Brazilian legal system the absence of specific standards that typify harassment as
crime, remaining to the courts the application in the case principles which protect the
worker human dignity. It was highlighted the existence by just state laws about, even
so, are applied only to the public position holders, not entering the private domain.
Also was examined the Brazilian jurisprudence, bringing cases in which there was
the recognition of the harassment practice and its consequent accountability, but
there are also cases in which the practice it wasn't recognized for lack of evidence.
This study proposes that human relationships inside a company are based on ethics
as a way to circumvent the harassment practice in the workplace.
