A presente pesquisa tem como objetivo analisar as regras de responsabilidade civil aplicáveis aos estabelecimentos bancários na hipótese de pagamento de cheques fraudados, tema extremamente atual, que traz em si um traço evolutivo do Direito Civil, que com o advento do Código de 2002, passou a consagrar normas mais coletivizadas, a admitir a coexistência das teorias da culpa e do risco de forma harmônica e não hierarquizada. Graças aos efeitos da dialética jurídica, o Código Civil vigente transmutou o núcleo das regras de responsabilidade civil, que antes se concentrava na busca do indivíduo culpado pelo prejuízo causado a outrem, mas, atualmente, é a busca por um responsável pela indenização, consagrando o princípio de que nenhum prejuízo deve ficar sem ressarcimento. No específico caso dos estabelecimentos bancários, aplicam-se as regras da responsabilidade civil objetiva, ou responsabilidade ―sem culpa‖, fundada na teoria do risco econômico, ou, em outras palavras, as instituições bancárias respondem pelos danos causados aos correntistas, por atos de seus prepostos, na execução de contratos bancários. Dentro deste contexto, se insere o ―contrato de cheque‖, cuja praticidade fez com que se tornasse usual em todos os recantos do país. Ocorre que, estelionatários criaram técnicas altamente sofisticadas para inovar ardilosamente informações do cheque com o objetivo de obter vantagens ilícitas, fraudes estas que, analisadas sobre o prisma da responsabilidade civil, geraram dissidia jurisprudencial, pois,
mesmo as regras objetivas de responsabilidade pareciam, em algumas hipóteses, serem insuficientes para identificação de um responsável pela indenização, considerando a ―culpa zero‖ dos prepostos do banco, e a impossibilidade material de encontrar o estelionatário, responsável direto pelo dano ao correntista, quase que na totalidade dos casos. A polêmica só foi resolvida com a edição da Súmula n. 28 da jurisprudência predominante do Supremo Tribunal Federal, que estabelece: ―o banco sacado responde pelo pagamento de cheque falsificado, salvo dolo ou culpa do correntista‖. Busca-se, nesta oportunidade, analisar as reflexões que conduziram a edição da referida súmula, por meio de uma abordagem dialética, onde será desenvolvida tese, no sentido de demonstrar que a culpa ainda é o núcleo da responsabilidade civil; antítese, que consiste na necessidade de se adotar, em determinadas situações, regras mais objetivas e coletivizadas, mitigando a culpa, com o objetivo de evitar que prejuízos fiquem sem ressarcimento; e síntese, apontando como as teorias da culpa e do risco podem coexistir no plano civilista. O procedimento metodológico será o histórico, o dedutivo e monográfico. |

This research aims analyzing the civil liability rules applicable to banking
institutions in the event of payment of fraudulent checks, extremely current
theme, object of an elegant discussion in the doctrine and jurisprudence, and that
brings with it an evolutionary trait of civil law, that with the advent of the 2002
Code, began to devote more collectivized standards, to admit the coexistence of
theories of guilt and the risk of harmonic and non-hierarchical way. Thanks to the
effects of legal dialectic, the current Civil Code transmuted the core of civil liability
rules, which previously concentrated on the individual seeks to blame for the
damage caused to others, but is currently searching for a person responsible for
compensation by establishing the principle that no harm should be without
compensation. In the specific case of banking institutions, apply the rules of
objective liability, based on the theory of economic risk, or, in other words, the
banks respond without fault, for damage caused to holders pursuant to acts
linked to the contract the minutes. In fact, bank contracts were considered as
consumer contracts, attracting application of the CDC, since the holders are
economic recipients of banking services. Within this context, it enters the so called "check agreement" whose practicality, did it become usual in every corner
of the country. Swindlers then created highly sophisticated techniques to
innovate cunningly check the information with the purpose of obtaining illegal
advantages. Fraud on checks, analyzed on the prism of liability, generated
Dissidia case law, since even the objective of liability rules seemed, in some
cases, insufficient to identify a person responsible for compensation, considering
the "fault zero" of the banking establishment and the physical impossibility of
finding the swindler, directly responsible for the damage. The controversy was
resolved with the enactment of Precedent. 28 of the prevailing jurisprudence of
the Supreme Court, which states: "the drawer bank accounts for the payment of
forged check, except malice or fault of the account holder." The aim is to take this
opportunity to analyze the reflections that led to the enactment of the score
sheet. Through a dialectical approach, theory will be developed, in order to
demonstrate that the fault is still the core of civil liability; antithesis, which is the
need to adopt, in certain situations, more objective and collectivized rules,
mitigating guilt, in order to prevent losses remain without compensation; and
synthesis, pointing out how the theories of guilt and the risk can coexist on the
civilian plane. The methodological approach will be historical, deductive and
monographic. |
