Resumo:
Considering the growing and worrying deregulation of labor norms due to the usual
and cyclical economic crises, the present paper aims to analyze the necessity for
caution and sensitivity to the change of workers' rights, so that the intended changes
in compatibility between capital and labor do not be cruel way to postponement of
workers' rights. It is noteworthy that the legitimate purpose of easing the
phenomenon substantially affects the hard-won rights for workers. In addition , it
emphasizes the weakness of the argument that links worker protection, as an
obstacle to economic and social growth of a country. The analysis surrounding the
principle of worker protection, and the disregard of this principle in the face of
economic crisis. For this, it was analyzed the process of training and development of
workers' rights, although the basic principles of Labor Law, the Constitution of 1988
and its complications on the theme. As practice result, it was observed due to the
decrease in the necessary protection to workers and molded according to the
convenience of capital market, it is indispensable the creation of a law that does not
give room for unilateral capital interests so that it protects workers from constant
threats arising from the already expected crises plaguing Brazil.
