This study lintel on the doctrinal divergence from psychopathy that is natural to why
studies have taken place over time with the need to characterize and understand
psychopathy and find solutions to problems, but all evolution on the subject He
served a multidisciplinary mosaic and more consistent in our study today. Some
people do not believe that there is this disorder that motivate individuals to commit
unlawful cruelly remnants, where private revenge still stands, with the aim of wanting
the prison system solves these problems or a prayer for a death sentence, injuring
the dignity of the human person and the good principles of morality and reason. The
legal system needs a criminal policy to cover the different situations of people with
criminal personality disorders, including psychopathy in this classification or dissocial
personality. The prison rehabilitation is apparently a utopia and the necessary
psychological treatment of affected by such disorders is far from check in practice.
This work aims to study alternatives to incarceration and rehabilitation of criminal
psychopaths as a subjective individual and collective right for the sake of legal
certainty. To achieve this end, the deductive method of approach is used, ie, will be
from an overview of the prison situation existing psychopaths in Brazil and the lack of
a legal treatment that creates a welfare policy to these types of criminals as a method
of procedure will be to use the history, evolution, comparative and the search for
indirect documentation technique comprising the doctrine, jurisprudence, legal
provisions, books, magazines and electronic items, as case law, information of the
