Abstract

This work has as main purpose to present a legal approach to State liability when those who represent it in the form of its public officials, exceeds the invested power and abuse it. Will present the history and evolution of general liability and also the State in particular. Where individuals, weakest parts in this relationship, can be used for civil liability institute to seek compensation for damages, perchance, have suffered, and the State in the first time the repair and then if deemed appropriate, imploring regressive action against the causative agent of the damage. In this research, the methods used are legal and exegetical, historical-comparative method and the literature. The work is structured into three chapters. The first chapter will focus on the general aspects of civil liability. In the second chapter will be talking about the liability of the State. And in the last chapter, it is a matter on the central theme of this work, which will be defended the civil liability of state entity in cases of abuse of power of its agents.
