This paper aims to present, analyze changes in the bidding process conducted by the differential charging system for hiring and its effects on public procurement succinctly, realize the key notions about public tenders, explaining its origin, concept and principles that guide the activity Administration in this matter, in order to highlight the importance of Law 8.666/93 in the regulation of bids and contracts the government. Being held minutiae about the principles that guide the activity of the Public Administration and exposing the origin and the application of the bidding procedure according to Law 8.666/93. Once this is done, will be to analyze the norms established by Law 12.462/11, responsible for implementing the Differentiated Contracting Regime (RDC) national legal system in order to assert its main changes as integrated procurement, variable remuneration, the confidentiality of budgets, stimulating the computerization, the open dispute so, the criterion of judgment of higher economic return, the negotiation with the bidder who offered the lowest tender and the inversion of the phases of trial and qualification, all with a focus on compared with this procedure in Law 8.666/93, being carried out a comparative study in order to allow an understanding of the subject of public procurement and aspects that changes were made in the bidding process. After the literature review and the positive study, it was concluded what were the real advantages developed by this new bidding process and what the failures observed, demonstrating the partial distortion of the RDC in some cases
