Resumo:
In view of the increasing use of the concession in the public services, the present study
aims to investigate in healthcare on the grounds of State Reform took place in 1997
and present a critical reflection on the subject. Based on the constitutional principle
that enshrines health as a fundamental right and what needs to be accomplished
through actions and State activities, this study aims to identify the participation of
private entities in the provision of public services, own the State. To this end, it is
intended, conceptualize the State (and mention your historical development) and
Public Administration (citing their core activities and the reform that took place
recently), lecturing about the ' right to health ', the ' public-private partnerships ' and '
grant ' Institute. The study will develop through the method of deductive approach, and
with regard to research techniques, will make the use of indirect documentation,
through bibliographical research. This essay also pervades the framing of these ideas
in the Brazilian legal system, demonstrating that the links concluded between the
public and private sectors, for the provision of health services, are scoped to the scope
of the efficiency and quality of service, and therefore the satisfaction of collective
interest. The work will appear in three chapters, introduction, conclusion and
references. The first chapter treats of the "State and public administration"; the second
will address the "right to health" in Brazil and the third will make an "analysis of the
partnerships in the public administration". In this sense, the search result showed that
it is of great importance the clarification of the theme issue of public health service
because of the managerial reform in the administration of the State, since there's still
a lot of divergence and complexity in procedures on the ' hiring ', provision and
supervision of health services by private entities.
