Resumo:
The objective of this study is to analyze the evolution of Brazilian household, provided
by the social changes and the disintegration of old values and customs, culminating in
the emergence of new loving arrangements and the subsequent reconstruction of the
current perception of family. Is examined the changes undergone by the Brazilian legal
system front contemporary family entities in order to achieve parallel families and their
specificities. It seems, that the family lost its purely political and patrimonial function
and leads to fundamental principles such as human dignity, the principle of affection
and the principle of private autonomy. Thereby, is sought the deepening of legal
valuation of concomitant families, reflecting the plurality family that solidifies daily. With
a short reflection on love and its plurality and the role and intervention of the state in
private life, remains observed a modified reality, still far from the ideal of social
understanding and legal protection. Gradually, simultaneous families has been
considered by the Courts and finding patrimonial visions obstacles and values of
monogamous family formation. Close our eyes to this reality result in encouraging this
practice which ultimately generate illicit enrichment and especially the breach of
constitutional principles. Not forgetting the appreciation of affection as bond that holds
the family ties, it examines the possibilities of denying or granting legal effect to parallel
family entities. The study is conducted by the deductive method, starting from a major
premise to reach the filing of the subject. Was used bibliographic search,
jurisprudence, doctrinal positions and the current legislation, to get to the reasoning
proposed by the research.
