Resumo:
This scientific research aims to analyze the influence of the media on the trials of the
Jury Court's jurisdiction crimes. The subject developed receives the title: "The
influence of media on the jury." The study was guided by the following objectives: to
analyze the systematic of this court, its evolution throughout history in antiquity, the
Middle Ages and today, focusing on the evolution of the Jury in Brazil; expose and
explain in detail the constitutional principles governing this institution, namely:
defense of fullness, secrecy of voting, sovereignty of the verdicts and minimal
competence to judge crimes against life; study its structure and organization;
discourse about the influence of media, freedom of speech, off press, of information,
right to publicity, and how it all leads to disrespect the principle of presumption of
innocence and others constitutional guarantees, generating confrontation between
fundamental rights citizen; and moreover, explain how the information in the press,
equipped with sensationalism and public outcry manipulate the opinion of society,
also contribute to this manipulation the notorious interest in publications related to
crimes, contributing to the offense is treated as a form of show and the public
condemnation of the alleged perpetrator / suspect / defendant; present and analyze
real and recent cases that have become true reality shows due to the heightened
exposure and tabloid press. Before the study, it was concluded that there is the clash
between the principle of freedom of the press and presumption of innocence, and to
solve this conflict the last shall prevail because of the first so that the suspect /
defendant has a fair trial, fully media influences free, demonstrating the free
conviction of the judges in judging the facts that are before such criminal institute.
The research consists in terms of theoretical framework of important works national
and international scholars, jurisprudence and information contained in specialized
articles published on websites. The scope of the proposed activity, there was the use
of bibliographic methods, exegetical and legal and collection of documentary
research data. It should be highlighted that the theme is current and relevant,
considering the role that the media play in society.
