Abstract:
This work seeks to understand the issues underlying the illegitimacy of immunity tax
of churches of any denomination. In terms of the method used, In terms of the
method used, it can be seen that the deductive best applies to work and the best
technique used is the indirect documentation.The strand used in this study was a
qualitative, in view of the importance of social concern that involves the topic, such a
method that best suits to the objective to be achieved with the work, combined with a
reading of the laws, doctrines and jurisprudence bringing together texts on the
subject, to seek the opinion on the issue. Throughout the research, the result
achieved makes us evaluate how flawed is the system that has created the
immunizing rule the temples of any cult, which through a teleological interpretation,
appears apparently illegitimacy, since the inordinate maintenance could be
detrimental to the whole society. Finally, it is necessary to better highlight the theme,
by doctrine, by scholars of the law, and also by the country's authorities, since daily
and in an indiscriminate manner religious leaders abuse the innocence of the faithful,
deceiving them and enriching himself unlawfully, benefiting from immunity, resulting
the immunity of churches of any denomination in evident illegitimacy because it’s has
been distorting its social purpose lacking an effective system that regulates this boon.
