Abstract:
The study analyzes in a systematic way the Brazilian prison system in the
perspective of the Constitutional Criminal Law especially the prison structure of the
Provisional Detention Centre in Currais Novos - RN and their reflections on human
dignity. The Provisional Detention Centre of Currais Novos - RN suffers the same
problems that are affected the others prisons in Brazil. The Brazilian prison system
faces a number of structural problems, such as overcrowded cells and the violation of
the rights of detainees. As a result of this problem arose numerous difficulties in the
serving of senteces, compromising the social rehabilitation of the prisoners, thus
hindering the achievement of the primary purpose of criminal law. The objective is to
demonstrate through the doctrine the criticism of the Brazilian prison system
conditions, as well,to evaluate the physical conditions of prison unit and its limitations
in the face of basic needs of prisoners and their impacts human dignity; to identify the
most psychological impacts from the daily contact with others; to verify the procedural
legal situation of detainees, detecting possible violations of rights and guarantees
related to the individuals. The methodology will be governed by the deductive
method, with a pure and exploratory research, looking for ideas that enhance
possibly help in addressing the problem, thus seeking to demonstrate through careful
analysis, the existing problems in the Detention Centre in Currais Novos. This
research is justified in order to contribute to a possible change in the Brazilian prison
system, pointing steps to comply with what the law states, solving existing
humanitarian concern problems in the Detention Centre of Currais Novos, State of
Grande do Norte.
