Résumé:
The present study was aimed at examining the institute of electronic monitoring of
prisoners was introduced into the national legal system by Law No. 12.258/2010 and
expanded its use by Law 12.403 / 2011. Refers to its origin, objectives and means of
use, highlighting the pioneering spirit of the state of Paraíba, who developed the first
device with national technology and auditioned in Guarabira County. Highlights the
main changes introduced by the above laws, showing Contrary attitudes and
favorable to the new instrument, and the practical implementation of electronic
monitoring systems for each Brazilian state. To this end was made an analysis of the
history of pens, demonstrating the emergence of the state and the foundations of ius
puniendi, and make a voyage to the main problems that afflict the Brazilian prison
system, such as the lack of adequate facilities, overcrowding, the lack of educational
and labor assistance, recidivism and internal violence.
