Resumen:
This monograph sought to describe about the issues that concern the probative
liability for granting the benefit of rural retirement age, an issue that deserves special
attention, since many are the difficulties faced by rural workers to seek advantage of
this social security law, given the many barriers that are present at the time of
confirmation of the exercise of rural activity. In this sense, the overall objective was to
describe the importance of social security law concerning the grant of the benefit of
rural retirement age. Already through the specific objectives sought to present a
historical context about the welfare and social security in Brazil and in the world; the
basic requirements envisaged in the social security law for granting the benefit of
retirement and analyzed the existing implications for the enforceability of evidence for
granting the benefit of the retirement age in rural. To achieve the proposed
objectives, were adopted as methodological assumptions one bibliographical study
from reading and BOOK REPORT texts in books, magazines, papers, among other
means bringing subsidies for the construction of our work. It can be seen that all
issues identified in the monograph, the result of bibliographic research, deepening
and confrontation of positions between the different actors involved in the research,
that barriers still relapse to documents to be submitted as evidentiary sources of rural
activities with the INSS - National Social Security Institute, as well as the different
interpretations that have just focusing on the skills and evidence. Thus, it appears to
be essential to be implemented, an effective and consistent partnership between the
parties involved in the search for solution of obstacles in order to correct and fair
implementation of the devices in effect.
