Resumo:
The present work aims to demonstrate that outsourcing model of business organization , has been disseminated in various sectors of the economy and has been used as an instrument for violating the rights of workers , still serving as a veil to cover slave labor or conditions analogous to slavery . The study will be essential because you can not allow that man again be treated as a commodity to the front faces of capitalism , from the perspective of profit maximization and cost reduction . In addition, the state should not conform to neoliberalism championed by companies outsourcing their activities form a chain of services that hampers the employee and the Labor Law finds the real employer. In our times , the Office of outsourcing and the mechanisms of violation of conditions of decent work expressed by the reduction to the condition of slavery have been analyzed in a section so , when it can not allow the makeup of work relations , since workers are marginalized and laboring with degrading conditions , with extensive journeys and inadequate work environments . Contemporary slavery in outsourcing should be fought under penalty of violation of fundamental human rights of the worker as well as the principle of human dignity . It is inferred therefore that it is essential to create specific legislation and with the application of punishments , as would occur if the PEC 438/2001 was adopted , and shall be repudiated all forms of expansion of outsourcing as intended including PL 4330/2004 . To conduct this study, the method used was the deductive approach , whereas the method of procedure used the historical method in addition to the achievement of this work was the use of indirect documentation .
