O laudo pericial no processo penal: análise de ferimentos por projétil de arma de fogo no crime de homicídio doloso.

Abstract

This work of Conclusion of Course has the general objective the study and the classification of injury from instruments of the perforating blunt specifically the firearm projectiles in the crime of intentional murder. The same has the following specific objectives: to study the expert report in criminal proceedings, aimed at the analysis of injuries produced by firearm projectile in the crime of intentional murder as well as the expert's acting, responsible for its preparation; differentiate corpus delicti and corpus delicti examination; discuss about the criticism of the criminological reports; involving the study of Pathology and Forensic Traumatology, branches of Legal Medicine; investigate the influential elements of the victim's death, among them, the distance of the shot and the trajectory of the bullet; and analyze some firearm characteristics and the projectile. The method of the approach is the deductive, starting from a general situation, the expert report, important evidence in criminal procedure, to unleash a specific aspect of this, namely, the analysis of injuries caused by action of the instruments perforating blunt, in shots per firearm, from a relationship of cause and effect, that is, the death of the individual. As for technique, it is about bibliographic research in the areas of Criminal Law, Criminal Procedure Law and Legal Medicine, as well as devices about the theme in the Federal Constitution and the penal legislation and criminal procedure extravagant. It was used with a way to enrich this project the field researches in the Center of the Legal Medical and Legal Dentistry of the city of Patos-PB, through the collection of data and the interpretation these, to check in locus of the theme of the study. Finally, the procedure is the monograph method with the objective to approach the intended subject.
