Abstract:
The relationship of alcohol consumption and violence are directly linked, especially
when observing this relationship in domestic violence crimes and traffic. But is this
relationship also comes in other forms of violence, like the crimes against life? Such
information has not been easily found in the available literature, which is why a case
study enables a better dimension of reality. In this context, this work has the aim to
develop a case study on the relationship between alcohol consumption and crimes
against life. Initially we draw two general goals, the first aimed at identifying the
percentage of cases before the Court the Jury of the County of Pau Irons / RN, in the
period 2009-2013, in which the parties (defendant and / or victim ) consumed alcohol.
The second is to check, how many of these cases, the parties requested, the Council
of Judgement or even to the judge, recognition of any mitigating (art. 28th, I and II of
the CP) or aggravating due to beverage consumption , specifically drunkenness
alcoholic foreordained. The methodology consisted of the collection of data through a
form, and these data received a qualitative and quantitative treatment by percentage
analysis and content. According to the survey, in the district of Pau Irons / RN, the
last 05 (five) years, the cases before a jury had a high frequency, between the
parties, the consumption of alcohol, reaching 70% (seventy percent) of the cases,
surpassing data in Brazil related to alcohol consumption and domestic violence and
traffic. In this north central contribution of this work lies externally, the need to
demonstrate to the competent authorities of the district of Pau irons strong
relationship of alcohol consumption and crimes against life as well, to discuss this
issue again in academic context, by comparing this with other Counties reality of
different states or regions of the country, so you can judge whether this phenomenon
also represents for Brazil and in what percentage.
