Abstract:
Using the Brazilian Penal Law as a parameter, this work descriptive, objective
analysis about the legal concept of melee weapons as well as its typicality against
the Brazilian criminal law, aimed at recognizing its decriminalization. We analyzed the
history of legislation pertinent to the subject, addressing some of the concepts
presented by law and doctrine, as well as a thorough analysis regarding the typical
behavior of its size and the regulations adopted and which could now be used as a
punitive means. Furthermore, we make profound about the classification and
suitability of the conduct of the size of stab analysis, showing the main standards, as
well as offering concepts, divisions and classifications for different types of melee
weapons, watching the criminal and constitutional principle applied to case under
discussion. To conclude, we discuss the various ways of penalizing satisfactorily
illegal possession of bladed weapons, so seeking the appropriate sanction for
criminal conduct and should penalize conduct resulting from the size, not the bearing
itself
