Abstract:
The present work is devoted to analyze some aspects concerning the integral
protection of children and adolescents in the face of advertising and the products and
services prohibited, since the 1988 Constitution, in its article. 227, created the Statute
of Children and Adolescents (Law 8.069/90), aiming to ensure the rights set forth in
our Constitution, listed with absolute priority to protect that menorista public, with the
basic law of child protection and adolescents, the ECA, enumerated lists many
products and services whose marketing is prohibited, as well as the Code of
Consumer Protection part listed mechanisms of protection against propaganda
aimed at children and adolescents. However as the goal to increase the sale of
products and services, we have various forms of abusive advertising. We tried to give
special focus on the excesses committed by the advertising aimed at children, with
the main focus advertising geared toward children, it is clearly noticeable that
advertisers consider them the best niche market to invest, as well consuming large,
they are being "trained" to consume more in the future. Therefore, we sought to
demonstrate how this advertising influences children's lives and that these high
investments in this sector come against, not only gives moral and ethics, as well as
the law. The work also devoted himself to examine all legal restrictions on advertising
malpractice, as well as present the products and services prohibited to minors.
During the research, it was found that this type of advertising is already banned in
our legal system. By systematically examining the specific statutes, we concluded the
work, realizing that these mechanisms to promote the protection of children and
adolescents are shown to be inefficient, since what has been observed in practice is
that of the lowest 18 years have free access to products and services prohibited,
children consuming drugs of different types, achieving acquire weapons and
ammunition, frequenting nightclubs, bars and motels, in flagrant disregard of the
constitutional and legal norms.
