Abstract:
The Parental Alienation although it is a concept still recent in Brazil, in 2010, it
ended up winning a specific Law. The Law no. 12.318/2010 came with the
intention of intensifying the protection warranty to the child and the adolescent,
enforcing true with larger rigidity the constitutional principles and fundamental right
inherent to these. The present dissertation has as theme parental Alienation and
the violation of the integral protection principle to the child. The argument
proposed here is to analyze the Syndrome of Parental Alienation, verifying that the
same violates the above principle. The presented hypothesis is the that children
and adolescents have greater need for attention during the period of legal
separation, observing their behavior, but also that of their parents It is had as
general objective of this work to develop an analysis on the parental alienation and
the consequences caused by it against the smaller, showing so the violation of
the child's integral protection principle. To analyze the moral and juridical
implications of the referred institute. Still, for specific objective, to verify the
relationship between father and son, during judicial divorce, and during
prosecution of custody of the child. To identify the alienating father, as well as
disturbances in the child's behavior in relation to the alienated father, analyzing the
violation to the child´s integral protection principle through the Parental Alienation.
To verify that the Parental Alienation is a problem of paramount importance in
what concerns the child's healthy growth, and that their effects are devastating,
both with regard to the child's relationship with the alienated father as the child's
relationship to other individuals.. In this monographic work, employs the deductive
method of the analysis of general data and the comparative method. It is indicated
the use of the technique of historical and bibliographical research with the
application of the direct and indirect documentation.
